OFFICIAL GENERAL CONTEST RULES

PLEASE READ

Any individual who enters, attempts to enter or in any way participates or attempts to participate in any contest, sweepstakes or giveaway (“Contest”) conducted by USA Diversified Media LLC., or its affiliate radio stations (each such individual is hereinafter referred to as a “Contestant”) agrees to be bound by the terms and conditions provided in these Official General Contest Rules (“General Rules”), as well as by USA Diversified Media LLC’s interpretations of these General Rules which are final and binding in all matters relating to any Contest. USA Diversified Media LLC. affiliate radio stations may be hereinafter referred to as (“Radio station”). Some Contests will have specific rules developed for them (“Specific Contest Rules”).  In the event there is a discrepancy or inconsistency between these General Rules and the Specific Contest Rules, the Specific Contest Rules shall control. 

Please note that certain contests promoted on USA Diversified Media LLC’s affiliate radio stations may be brought to you by another sponsor or by a sponsor other than USA Diversified Media LLC.

CONTEST PERIOD: USA Diversified Media LLC. runs many social media and live on air Contests throughout the year across United States. For these Contests, the Contest Period, duration and timing will be set by USA Diversified Media LLC., and are subject to change.

Eligibility restrictions:

1. Unless otherwise noted, the affiliate Station’s contests are open to individuals 18 years of age and older.
2. All contestants must be legal U.S. residents and possess a valid form of identification bearing the picture of the contestant. The Station may request that valid ID be presented to the Station or its agents before the prize is awarded.
3. Only one winner per household is permitted in a 30-day period of all Station contests. Any prize awarded to an ineligible listener will be deemed null and void and an alternate eligible winner may be named at the sole discretion of the Station.
4. The Station staff members, station volunteers, and employees USA Diversified Media LLC or it’s affiliate radio stations are ineligible to participate or win.
5. No purchase is necessary to enter or win. A purchase or payment will not increase your chance of winning.
6. The Station’s contests are void where prohibited. All federal, state, and local laws and regulations apply.

The following people are not eligible:

1. Employees of USA Diversified Media LLC or it’s affiliate radio stations, during the Contest Period;
2. USA Diversified Media LLC. and affiliate radio station personalities on air anytime between the start of the Contest Period and up until the prize is awarded;
3. Employees of Sponsor/Prize Provider as well as those of their respective affiliates;
4. Members of the Judging Panel;

Conditions:

1. By participating in a station contest, contestants agree to be bound by the official rules and the decisions of the judges, which are final and binding in all respects.
2. By participating in the contest, all winners agree to allow the affiliate Station and USA Diversified Media LLC, to use their personal information for internal use and for correspondence with venue and artist management.
3. By participating in the contest, each winner agrees to have his/her name mentioned on air and for use in any advertising/promotional materials related to this contest without additional financial or other compensation.
4. By participating in the contest, individuals assume that their call may be broadcast or recorded and therefore grant the Station permission to broadcast the call or record if for later broadcast.
5. The Station, at its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operations of the Station, or who is otherwise in violation of the rules. The Station further reserves the right to cancel, terminate or modify the contest if it is not capable of completion as planned. The Station also reserves the right to make changes in the rules of the contest including the substitution of a different prize of equivalent value, which will become effective upon announcement
6. Failure to comply with the contest rules may result in a contestant’s disqualification, at the sole discretion of the Station.
7. The Station is not responsible for and shall not be held liable for, any technical, mechanical, electrical or performance malfunctions in the offering or the administration of the contest or in the announcement of the prize.
8. As a condition to acceptance, all contest winners must release the affiliate Station and USA Diversified Media LLC or its employees, officers and agents from any and all liabilities arising directly or indirectly from using the prize.
9. Winners shall be responsible for any taxes imposed on receipt of the prize.
10. Prizes awarded are not redeemable for cash. No prize is transferable. No substitution for a prize will be made at the request of winner. The Station reserves the right to substitute a prize of similar or equal value.
11. At its sole discretion, the affiliate Stations shall determine how listeners claim their prizes, including but not limited to “guest listing” ticket winners, postal mailing or emailing prizes to winners.
12. Decisions of the affiliate Station and USA Diversified Media LLC management with respect to contests are final.
13. Contestants should regularly monitor the Station’s website and social media for information, updates and possible changes to each station contest.

General Contest Rules

All participants must be 18 years of age or older, depending on the contest. Persons may win only one prize from the affiliate radio station per contest for every 30 day period. Some contests might also specify one winner per household or company. Prizes must be claimed within 21 days, or by 48 hours the day before the event (whichever is sooner) and must be accepted as is or forfeited. All winners must meet all individual station contest eligibility requirements, which include but are not limited to, providing picture identification, social security number (for tax purposes), and signing a release form in order to receive the prizes won. Winners of affiliate station contests, by their acceptance of prize(s) grant the radio station free of charge and in perpetuity the right to use their name, voice and likeness in any or all radio station publicity surrounding the contest promotion. The decisions of the radio station Management are final. Winners are responsible for any and all taxes incurred as a result of their winnings. Each winner of prize(s) valued at or with a combined value of at least $600 will receive an IRS 1099 form at the end of the calendar year. Some prizes may require the winner to pay sales tax in addition. The radio station employees and their immediate relatives, sponsor employees and their immediate relatives, live remote sponsor employees and their immediate relatives, and any other media employees are ineligible to win the prizes. The affiliate radio station reserves the right to stop the promotion at any time for any reason, including a national disaster, terrorist activity (or the threat thereof), or any other event reasonably beyond the control of the station. By entering the contest, each contestant agrees to comply with the all of the contest rules. NO PURCHASE NECESSARY. All prizes are non-transferable. No cash or other substitutions are allowed. Prizes have no cash value. Odds of winning are dependent upon the total number of contestants who enter Contest using the affiliate radio station’s signup form on the radio station’s website. Rules are subject to change without notice.

Purchase: No Purchases necessary and contest is void where prohibited by law. Prizes are non- transferable.

Drawings: All prizes will be awarded on the basis of random drawing unless otherwise stated. Conditions of Awarding Prizes: Unless otherwise specified by USA Diversified Media LLC., from the date awarded all prizes emailed, USPS mailed or expressed mailed within thirty (30) calendar days, which includes weekends and holidays. It is the winner’s responsibility to claim their prize by email, US Postal or Express Mail. Winner must present valid state issued photo identification following a facetime or video call prior to delivery of their prize and in the case of a cash prize or high value prizes, their Social Security number. Depending on the contest and/or prize, a prize may be mailed to winner’s designated mailing address. In such case, USA Diversified Media LLC is not responsible for timeliness and delivery of mail. USA Diversified Media LLC is not responsible for replacing lost or stolen prizes. Winners may be required to complete and sign a Form W-9 in order to claim prize. Winners and their guests, as applicable, must agree to sign a consent form, without additional compensation, for use of their name, voice, and/or likeness for any promotional purpose.

SPECIFIC ENTRY-METHOD RULES: 

Telephone Entry Contests:  If a Contest accepts website entries, all entries must be made to the website as designated on-air or the affiliate station’s website. 

The affiliate radio staion, may record and/or broadcast a Contestant’s name, voice and the substance of all or any portion of the call.  Except where prohibited by law, any Contestant acknowledges that such recording and use may occur and grants USA Diversified Media LLC. permission to record and use such recording without any additional communication with and compensation to Contestant. If required contestant may be required to sign a consent form provided by the station.

Electronic Mail (Email) Entries:  If a Contestant accepts electronic mail entries, all entries must be received by the affiliate radio station by the Entraffiliatey Period deadline, unless otherwise stated. 

Conditions For Major Prizes: A contest winner that accepts a prize that is of a $600.00 value or more must, as a condition of accepting the prize, sign a release holding USA Diversified Media and parent company, affiliated companies and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or contest. If the prize includes travel provisions, whether or not such transportation is provided by USA Diversified Media LLC., winners will be required to sign a liability release. Contestants winning a prize or prizes valued at over $600.00 or more in a calendar year will be issued a Form 1099, and will be subject to any and all federal, state and local taxes, as applicable.

Substitutions: Affiliate radio station listeners who win prizes from the affiliate radio station may not request substitute prizes with another prize or cash. In the event of the unavailability of a prize, USA Diversified Media LLC may substitute another prize for the original, provided the substitute prize is of the approximate dollar value of the original prize awarded. Certain restrictions may apply to prizes given away.

Website Contest and Registration: Listeners may register to win prizes on the affiliate radio station’s web sites. Winners of the various contests are chosen randomly from all eligible entries. Affiliate radio stations are not responsible for entries not received due to difficulty accessing the Internet, service outages, or delays. Computer Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. One Internet entry per person. USA Da Banger, in its sole discretion, reserves the right to disqualify any person who in its judgment has tampered with the entry process, the operation of the affiliate radio station’s websites or is otherwise in violation of the rules. It further reserves the right to cancel, terminate or modify the contest if it is not capable of completion as planned including the infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any kind.

Hold Harmless: USA Diversified Media LLC., their parent company, agencies, sponsors, employees, and representatives absolve themselves and shall be held harmless from any action or liability arising from any affiliate radio station’s contest or the prizes awarded in a contest. Winners and their guests, as applicable, shall indemnify USA Diversified Media LLC., its parent company, affiliates, employees and agents from and against any and all liability, loss, damage, cost, or expense resulting in any negligence and/or intentional acts of others in any way relating to or arising out of the winners’ and/or guests’ receipt, and/or use of the prize.

Promotion Rights: All contest entries become the property of USA Diversified Media and it’s affiliate radio stations. USA Diversified Media LLC. may withhold any or all contest materials for any reason affiliate station’s management deems material to the completion of the contest, or for reasons relating to publicity and/or advertising.

Entries Are the Sole and Exclusive Property of USA Diversified Media LLC:  All Contest entries and/or related submissions become the sole and exclusive property of USA Diversified Media LLC upon transmission. Contest entries will not be returned and may be used by any Contest Entity for any purpose whatsoever related to any Contest, without additional compensation to the Participant or any other individual or entity. 

Disclaimer:

The affiliate Stations or USA Diversified Media LLC. undertakes no liability or responsibility, and makes no warranties, express or implied, with respect to the performance of the prize(s) awarded, for any failure to perform or negligent performance of any service provider, or for any other risk, incident or damage, direct or indirect, relating to or arising out of the contest, including (but not limited to) cancellations, postponements, delays or other scheduling changes; missed events or connections or inability of winner to attend; and accident, injury, death, damage or expense arising from or occurring during the use of the prize, or travel to/from or attendance at any event relating to the contest, by the winner and/or winner’s guest(s). The affiliate Stations are not responsible for damage to a prize or loss of a prize after the prize has been claimed. The affiliate Stations are not responsible for technical, hardware or software failure or malfunctions, lost or unavailable network or other telecommunications connections, or lost, late, damaged, illegible, inaccurate, incomplete, garbled, disconnected, or delayed contest entries or communications, whether caused by the sender or by any of the equipment or programming associated with or used in this contest, or by any human error which may occur in the execution of this contest. If, for any reason, the Contest is not capable of being conducted as planned, including but not limited to infection by computer virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond the control of the Station. The affiliate Stations reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest and award the prize from among all eligible entries received to date.
